| Resumo: | A proteção da criança e do adolescente nos dias atuais constitui uma das maiores preocupações dos juristas, cientistas sociais, governantes e sociedade em geral. O crescente número de casos criminais, envolvendo menores, assusta a sociedade e põe em alerta as autoridades. Ao mesmo tempo, possuímos uma legislação que visa proteger, amparar e salvaguardar direitos de crianças e adolescentes, considerada uma das mais modernas do mundo. O Estatuto da Criança e do Adolescente, Lei no. 8.069, de 13 de julho de 1.990, bem como a Constituição Federal, artigo 227, praticamente se constituem na síntese da Convenção da Organização das Nações Unidas ONU, de 1.989, ao declarar os direitos especiais da criança e do adolescente, como dever da família, da sociedade e do Estado. Por ser matéria ampla e complexa, ativemo-nos em especial, em um de seus aspectos, o direito do menor a convivência familiar, por ser, no nosso entendimento uma das pedras basilares da questão, pois envolve a família, instituição necessária ao ser humano, única capaz de garantir o pleno desenvolvimento de sua personalidade, garantindo, assim, a preservação de todos os demais direitos dessas pessoas especiais. Com a evolução da sociedade, o homem mudou, adequando seu comportamento às novas situações. Por conseguinte, o direito, por ser dinâmico, acompanhou tais mudanças, adequando a lei à nova realidade. Novas formas de uniões entre homem e mulher surgiram as entidades familiares. As maneiras pelas quais o homem se comporta nessa nova realidade, bem como os reflexos que isto traz a prole, além dos mecanismos de que o operador do direito dispõe para garantir a proteção de direitos fundamentais, é o objetivo de nosso trabalho |
| Abstract: | The protection of the child and the teens in the current days is constituted one of the biggest worries of jurists, social scientists, governors and the society in general. The increasing number of criminal involving minors scares the society and put our authorities on their guard. At the same time, we have a legislation that aims to protect, support and safeguard rights of children and teens, considered one of the most modern in the world. The Statute of the Child and the Teens, Law number 8,060 of july 13m 1990, as well as the Federal Constitution, article 227, practically constitute the synthesis of the United Nations Organization Convention of 1989, when declaring the special rights of the children and teens, as duty of the family, the society and the State. As it is a broad and complex matter, we have specially clun to one of this features, the right of the minor to the familiar intimacy, as we understand it constitutes one of the foundations of the issue, as it comprises the family, an institution necessary to the human being, the only able to guarantee the whole development of his/her personality, guaranteeing thus, the preservation of all the other rights of these special persons. With the evolutions of the society, man has changed, adapting his behavior to the new situations. Accordingly, the Law, being dynamic, kept up with such changes, adapting the law to the neu reality. New forms of union between man and woman appeared the familiar entities. The ways by which tha man behaves in this new reality, as well as the consequences this brings to the offspring, besides the tools the law operation has to guarantee the protection of the fundamental rights, is the objective of our work. |
