| Resumo: | A liberdade sindical é princípio fundamental, sem o qual, não haverá respeito à dignidade da pessoa humana. Constitui-se em tema amplo e inesgotável. A presente pesquisa busca contextualizar essa liberdade sob o prisma histórico-filosófico, analisando-a num mosaico de múltiplos aspectos que a cercam, concluindo que tal liberdade configura-se em direito fundamental, pilar na construção de um Estado Democrático de Direito. Para tal desiderato, busca-se, neste estudo, analisar a liberdade sindical especificamente prevista no caput do art. 8° da atual Constituição Federal e das restrições contidas nos incisos 11e IV deste mesmo dispositivo, em face de outras disposições contidas na mesma Carta, e, em especial, no cenário internacional,dos tratados sobre a matéria, ratificados ou não pelo Brasil, registrando, também, o entendimento de parte da doutrina nacional e estrangeira sobre o tema. A Carta Constitucional de 1988 eleva a dignidade da pessoa humana à condição de princípio fundamental da República Federativa do Brasil, que se constitui em Estado Democrático de Direito. A liberdade sindical tem na dignidade da pessoa humana o fundamento basilar de sua existência. É, portanto, um direito fundamental, sendo assim, largamente considerado no cenário internacional. As restrições constitucionais a essa liberdade não se harmonizam no contexto internacional, por não serem justificadas e nem razoáveis, cujo resultado é não se ter, no âmbito nacional, uma liberdade sindical plena |
| Abstract: | The syndical freedom is basic principie, without which, it will not have respect to the dignity of the person human being. It consists in an ample and inexhaustible subject. The present research aims to context this freedom under the historical and philosophical prism, analyzing it in a mosaic of multiple ~ aspects that surround it, concluding that such freedom is configured in basic right, column inthe construction of a Democratic State of Right. For such desideratum, it longs for, in this study, to analyze the syndical freedom specifically foreseen in the eighth article caption of the current Federal Constitution and the restrictions contained in the II and IV interpolated propositions of the same Device, in face of other disposals contained in the same Letter, especially in the international scene, in the agreements on this subject, ratified or not for Brazil, registering, algo, the thought of part of the national and . foreign doctrine on the subject. The Constitution of 1988 raises the dignity of the person human being to the condition of basic principie of the Federative Republic of Brazil, that it itself constitutes in Democratic State of Right. The syndical freedom has in the dignity of the person human being the principal bedding of its existence. It is, therefore, a basic right, being thus, wide considered in the international scene. The constitutional restrictions to this freedom do not harmonize in the international context, for not being justified and nor reasonable, whose result it is not to have, in the national scope, a full syndical freedom |
